1. About these terms

These Terms of Service ("Terms") govern your use of TakeawaySoft (the "Platform"), a software-as-a-service that lets food businesses ("Merchants") accept online orders from their customers. By signing up for the Platform, the Merchant ("you") agrees to these Terms.

2. Account & eligibility

You must be a legally registered business, at least 18 years old, and authorised to bind the Merchant entity. Each subdomain ({merchant}.takeawaysoft.com) is for one legal entity; sub-leasing your tenant to a third party is not permitted.

3. Plans, fees, and billing

Pricing and per-order commission rates are set out in your subscription plan, viewable in your admin panel. You authorise us to charge the payment method on file. Fees are non-refundable except where mandated by law.

4. Your content & data

You retain ownership of the data you upload (menu items, photos, customer lists, order records). We use it only to provide the Platform to you and as described in our Privacy Policy.

5. Acceptable use

You agree not to: (a) sell prohibited goods (illegal items, controlled substances outside licensed contexts), (b) use the Platform for harassment, fraud, or to deceive customers, (c) attempt to circumvent rate limits or security controls, (d) reverse-engineer or scrape the Platform beyond your own data.

6. Payments & refunds

When Stripe Connect is integrated, customer payments flow into your connected Stripe account, less our application fee. Refunds to your customers are your responsibility; we facilitate the refund flow but do not act as merchant of record for your sales.

7. Suspension & termination

We may suspend or terminate your account for violation of these Terms, non-payment, or legal compulsion. You may close your account at any time from the admin panel; we retain your data for 30 days for restoration before permanent deletion.

8. Liability

The Platform is provided "as is" without warranties beyond those required by law. Our liability is limited to fees you paid in the 12 months preceding the claim.

9. Changes

We may update these Terms; material changes will be notified 30 days in advance via email and an in-product banner.

10. Governing law

These Terms are governed by the laws of England and Wales. Disputes are subject to the exclusive jurisdiction of the English courts.
